Data Dive Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services provided by Data Dive, accessible at https://datadive.tools and through associated applications including the Data Dive Chrome extension (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
1. Use of the Services
Data Dive provides software tools and analytics designed to assist users with product research, keyword analysis, ranking tracking, and related marketplace insights.
Subject to these Terms, Data Dive grants you a limited, non-exclusive, non-transferable license to access and use the Services for your own internal business or personal purposes.
You agree not to:
- reverse engineer, decompile, or attempt to extract the source code of the Services
- copy, reproduce, or redistribute any portion of the Services
- use the Services in violation of applicable laws or marketplace terms
- interfere with the operation or security of the Services
- use the Services to build a competing product, scrape data in bulk, or train machine learning models.
Data Dive reserves the right to suspend or terminate access to the Services at its sole discretion, with or without notice, including in cases where these Terms are violated, or where activities such as payment disputes, abuse of refund policies, system abuse, or other behavior negatively impacting the Services occur.
2. Accounts
To access certain features of the Services, you may be required to create an account.
You agree to:
- provide accurate and complete account information
- maintain the security of your account credentials
- promptly notify Data Dive of any unauthorized access to your account
You are responsible for all activity that occurs under your account.
3. Subscription and Billing
Certain features of the Services require a paid subscription.
By subscribing to a paid plan, you agree that:
- subscription fees will be billed in advance for the selected billing period
- subscriptions automatically renew unless cancelled before the renewal date
- you are responsible for all applicable taxes associated with your subscription
Billing is processed through third-party payment processors, and Data Dive does not store full payment card information.
You may manage or cancel your subscription through the account billing page available within the Services.
Access to the Services, including account availability and the ability to use subscribed features, constitutes delivery of the Services for billing purposes.
4. Cancellation
You may cancel your subscription at any time through the account management interface.
If you cancel your subscription:
- the cancellation will stop future billing
- your access to paid features will continue until the end of the current billing period
- no additional charges will occur unless you choose to renew the subscription
5. Refund Policy
Subscription payments are generally non-refundable once a billing period has begun.
However, Data Dive may, at its sole discretion, issue partial or prorated refunds in certain circumstances.
Refund decisions are evaluated on a case-by-case basis and are not guaranteed.
Temporary interruptions, delays, partial unavailability, degraded functionality, or issues affecting specific features do not entitle users to refunds, credits, or other compensation, except where required by law.
6. Data Sources and Methodologies
The Services aggregate and present data obtained from multiple sources, including:
- external marketplace platforms
- official APIs where available
- third-party data providers
- proprietary analytical methods and modeling
Because data is collected and processed using various methodologies, the information displayed within the Services may differ from results observed directly on external platforms.
Differences may occur due to factors including but not limited to:
- data collection timing
- geographic variations
- personalization of search results
- marketplace algorithm changes
- differences in data provider methodologies
Data Dive does not guarantee that data displayed within the Services will exactly match results observed directly on external marketplaces, and users should not rely on the Services as the sole basis for business decisions.
7. Third-Party Services
The Services may rely on third-party providers and integrations to obtain data or provide certain functionality.
Data Dive does not control and is not responsible for the availability, accuracy, or reliability of services provided by such third parties.
Changes, interruptions, restrictions, or other actions taken by third-party platforms or providers may affect the functionality or accuracy of the Services. This includes, but is not limited to, changes to websites, APIs, terms of service, browser updates, or Chrome Web Store policies, which may impact the availability or functionality of the Services, including the Data Dive Chrome extension.
You are solely responsible for ensuring that your use of the Services complies with the terms, policies, and requirements of any third-party platforms you access or use in connection with the Services. Data Dive is not responsible for any suspension, restriction, penalty, or loss arising from your relationship with such third-party platforms.
8. Support
Data Dive may provide customer support through documentation, email, or other support channels made available through the Services.
While Data Dive strives to assist users and respond to inquiries in a commercially reasonable timeframe, the availability, format, and response time of support are not guaranteed unless explicitly stated in a separate written agreement.
Support is provided on a best-effort basis.
9. Disclaimer
The Services and all related materials are provided “as is” and “as available.” Data Dive makes no express or implied warranties, including merchantability, fitness for a particular purpose, or accuracy/completeness of data. Use of the Services is at your own risk.
Data provided through the Services is for informational purposes only and should not be considered business, financial, or investment advice.
Data Dive does not guarantee the continued availability of any particular feature, functionality, integration, or data source, and access to specific features may change, be interrupted, or be discontinued at any time.
10. Data Access
Usage: Data Dive will not use seller data obtained through the Services to compete against users. However, we may access your data as needed to develop, maintain, and support the software.
Statistics: We may analyze aggregated usage statistics and patterns to improve the Services.
Support: Our team may access your data when necessary to provide technical support, strictly limited to what is required and handled with respect for privacy and security.
11. Limitation of Liability
To the maximum extent permitted by law, Data Dive and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.
This includes but is not limited to:
- business losses
- lost profits
- data inaccuracies
- interruptions in service
In no event shall Data Dive’s total liability exceed the amount paid by you for the Services during the twelve months preceding the claim.
12. Modifications to the Services
Data Dive may modify, suspend, or discontinue any portion of the Services at any time without prior notice.
Data Dive shall not be liable for any modification or discontinuation of the Services.
Updates, modifications, or releases may introduce errors, interruptions, or changes in functionality. Data Dive is not liable for any impact resulting from such changes.
The Services may experience interruptions, delays, or partial unavailability, and such events do not constitute a failure to deliver the Services.
13. Intellectual Property
All content, software, trademarks, and materials provided through the Services are the property of Data Dive or its licensors and are protected by applicable intellectual property laws.
You may not use Data Dive trademarks, branding, or proprietary materials without prior written permission.
14. Service Data and Outputs
Data Dive retains all rights, title, and interest in and to the Services, including all underlying software, datasets, analytical models, and derived data generated through operation of the Services.
Users retain ownership of any data they submit to the Services (“User Data”).
The outputs, analytics, rankings, and insights generated by the Services are provided for the user’s internal business use only and may not be reproduced, redistributed, sold, or used to develop competing products or services.

These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

Data Dive may update these Terms from time to time.
Updated versions will be posted on this page with an updated “Last Updated” date.
Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
